MEMBER CONTRACT - COOL KIDS PICKLEBALL CLUB OF KELOWNA

RELEASE OF LIABILITY, WAIVER OF CLAIMS, ASSUMPTION OF RISKS AND INDEMNITY AGREEMENT. BY AGREEING TO THE TERMS OF THIS DOCUMENT, YOU WILL WAIVE CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE. PLEASE READ THIS CONTRACT CAREFULLY.

CLUB NAME: Cool Kids Pickleball Club of Kelowna, hereinafter to be referred to as ("CKPC")

CLUB MEMBERS: CKPC Members, hereinafter to be referred to as ("MEMBER(S)")

TOURNAMENT DIRECTOR: Hereinafter to be referred to as ("TD")

MEMBER data: Any data about a member or their activity collected directly or indirectly

MEMBER personal data: Any data about a member collected directly or indirectly

ASSUMPTION OF RISKS

MEMBERS are aware that belonging to the CKPC exposes them to many inherent dangers, hazards and risks associated with their physical, emotional well-being, and property. By engaging in any activities offered by or associated with CKPC, MEMBERS freely accept and fully assume all inherent risks, dangers, hazards, and damages including but not limited to, the possibility of personal injury, death, property damage, and mental/emotional stress (from any type of trigger language, images, video or audio, or other external stimuli). CKPC will not be responsible or liable for any loss resulting there from above.

LIABILITY

MEMBERS assume all liability for their actions during league/recreation play or any event hosted by the CKPC. MEMBERS understand pickleball is a sport with potential injury risks including death and do so at their own risk. MEMBERS are aware insurance is not provided by the CKPC and should obtain the necessary insurance to protect themselves. Any facility used to host CKPC activities will be governed by the facility's usage agreements with the understanding that the CKPC does not use or schedule any playing facility for regular season league events. CKPC will suggest a date and location for a playoff event at the beginning of a league event however, players may collectively change the venue if they choose to do so. CKPC is strictly the mechanism to connect MEMBERS and manage their rankings while MEMBERS coordinate and play at their sole discretion. CKPC is not responsible for MEMBERS or others conduct. MEMBERS release and hold harmless the CKPC, it's members, volunteers, associates, affiliated associations, sponsors, or any other individual or entity associated with the CKPC, from any liability or claim arising from participation in any event, tournament, or activity held by the CKPC and/or it's MEMBERS. In addition, MEMBERS will release and hold harmless the CKPC for any information provided or disseminated by any CKPC Officer, Associate, or club MEMBER.

PRIVACY

CKPC requires MEMBER personal information and MEMBER club activity in order to operate. Data provided by CKPC MEMBERS and MEMBER data processed by CKPC is solely owned by CKPC, even after a MEMBERS membership is cancelled or terminated. CKPC will reasonably protect MEMBER information from non-MEMBERS however, MEMBER information will be made public in order to facilitate games, events, and club promotion. In the event that any type of MEMBER information is made public, accidentally, or intentionally, CKPC will not be held liable for any damages as a result of the public dissemination of MEMBER information. Any questions or concerns about our privacy policy can be directed to our Privacy Commissioner at admin@coolkidspickleball.com.

LIKENESS RELEASE

I hereby grant permission to the rights of my image (photo or video), likeness, and sound of my voice as recorded on audio or video to the CKPC without payment, compensation, royalties, or any other consideration. I understand that my image may be edited, copied, exhibited, published, distributed, and/or redistributed and waive the right to inspect or approve the finished product wherein my likeness appears.

MEMBERSHIP

Candidates for CKPC membership must be at the AGE OF MAJORITY in the location they apply for membership/events in, reside in, and where they participate in CKPC activities in; while candidacy is at the ultimate discretion of the CKPC President. MEMBERS may be revoked of membership at anytime, for any reason, or for no reason whatsoever, without explanation. CKPC communicates primarily by, but not limited to, email. MEMBERS may unsubscribe to any CKPC communication, effectively cancelling their CKPC membership, by emailing admin@coolkidspickleball.com with the subject line "Cancel Membership". All former MEMBER data is subject to our PRIVACY policy. Membership does not necessarily entail or guarantee any or all implied past, present, or future CKPC offerings. Members agree to review and accept current and all future MEMBERSHIP CONTRACT iterations or otherwise cancel their membership.

GOVERNANCE

CKPC is governed by the CKPC President. The TD is appointed by the President. Appointment of these roles can change at any time, without notice.
